Terms of Service

Este texto só está disponível em inglês.

1. About these Terms

These Terms of Service ("Terms") apply to HaruHost (also called HaruHost GSM), operated by Raidenku MB, a company registered in Lithuania ("we", "us", "our"). HaruHost is made up of:

  • the HaruHost desktop app and background service for Windows and Linux (the "Software");
  • the web panel at https://gsm.haruhost.com;
  • the website at https://haruhost.com;
  • the HaruHost Discord bot, the Tunnel and the other online services the Software connects to.

Together these are the "Service". By downloading, installing, signing in to or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Our Privacy Policy (https://haruhost.com/policy/) explains how we handle personal information.

2. Early stage of development

HaruHost is in an early stage of development. Features may change, and some may not work as expected or may be interrupted. By using the Service, you accept these risks.

3. Definitions

  • "Account" means the HaruHost account you sign in to with Discord, Google or Patreon.
  • "Machine" means a computer, home server or rented server (such as a VPS) on which you install the Software and sign it in to your Account.
  • "Game Server" means third-party dedicated server software that you install, run or manage with HaruHost.
  • "Plan" means a free or paid level of the Service, with the features and limits shown on the pricing page.
  • "User" means anyone who downloads, installs or uses the Service.

4. Accounts and sign-in

You sign in with a Discord, Google or Patreon account. Each of these is a separate HaruHost Account; signing in with a different provider creates a different Account, with its own Machines and Plan.

You must be at least 18 years old to create an Account, and the information you give us must be accurate and current.

You are responsible for everything done with your Account, including on the Machines signed in to it, by the web panel admins you invite and through the Discord bot commands you allow. Keep your Account, your sign-in provider account and your Machines secure, and tell us at once if you notice unauthorized use.

We may refuse service, and we may suspend or close Accounts as described under Termination.

5. Plans and subscriptions

The Plans we offer, their prices and what each includes (for example, the number of Game Servers and Machines, and features such as the Tunnel, automations, backups and the Discord bot) are shown on the pricing page (https://haruhost.com/pricing/) and in the app.

Paid Plans are subscriptions, billed in advance for each billing period ("Billing Cycle"), monthly or yearly as you choose. A subscription renews automatically at the end of each Billing Cycle until you or we cancel it. If you change to another Plan, the change applies right away and the price is adjusted for the rest of the Billing Cycle.

While we offer a free Plan, it is for personal use and has limited features. We may change, limit or stop offering the free Plan at any time.

We may also offer one-time purchases for additional benefits. Unless stated otherwise, they stay available while your Account is active.

A subscription does not include personal support unless its Plan says so.

6. Payments and cancellation

We do not process payments ourselves. Each purchase is sold and charged by a merchant of record. We currently use:

The merchant of record's own terms also apply to your purchase, and charges appear on your statement from it rather than from "HaruHost". By paying, you authorize it to charge the subscription fees to your payment method. If an automatic payment fails, the merchant of record may ask you to pay manually by a deadline.

You can cancel a subscription at any time from the subscription card in the app, through the merchant of record (for example, your Patreon membership settings) or by contacting us. Cancelling stops the next renewal; your Plan stays active until the end of the Billing Cycle you have paid for.

7. Price and Plan changes

We may change our prices and Plans. Changes usually apply to new subscriptions only; existing subscriptions usually keep the price they started with.

If a price change applies to your existing subscription, or a change reduces what your paid Plan includes, we will give you reasonable notice before it takes effect, so that you can cancel first. If you keep your subscription after the change takes effect, you accept it. In some cases we may need to end existing subscriptions because of such a change.

We announce price changes and other important updates in our Discord community (https://discord.com/invite/Y345XFmKps).

8. Commercial use

Paid Plans may be used for Game Servers you run commercially, as long as the Plan covers the Game Servers involved and you follow the terms of the games you host.

Providing game server hosting to others, such as renting or reselling Game Servers or server slots, is not part of any current Plan. Contact us before using HaruHost this way.

9. Refunds and chargebacks

We consider refund requests case by case and grant them at our discretion. Cases we may refund include a renewal charge for a new Billing Cycle that you meant to cancel before it began. Refunds are paid through the merchant of record.

Nothing in these Terms limits any right to a refund or to withdraw from a purchase that you have under the consumer law of your country or under the merchant of record's terms.

Please contact us before disputing a charge with your bank or payment provider, so that we can look into it with you. If you start a chargeback without contacting us first and giving us a reasonable time to resolve it, we may close your Account and end the associated services.

10. License

We grant you a personal, non-exclusive, non-transferable license to use the Software on your Machines, under these Terms and your Plan. The license does not give you ownership of the Software.

You may not:

  • reverse engineer, decompile or disassemble the Software, except where the law allows it;
  • modify the Software or create derivative works based on it;
  • remove or alter copyright or other proprietary notices;
  • use the Software for any illegal activity.

11. Your Machines and Game Servers

HaruHost runs on Machines you own or rent, and your Game Servers run there. We do not host your Game Servers. You are responsible for your Machines, including their security, updates, firewalls and backups, whether they are at home or with a hosting provider.

You are also responsible for:

  • following the terms of the games, publishers and mod sources you use;
  • having the right to run each Game Server you set up, with its mods and content;
  • what happens on your Game Servers and in the communities around them, including your players' content and chat;
  • the information about your players that HaruHost collects or shows for you, as described in the Privacy Policy, including telling your players about it where the law requires it.

Any damage caused by problems with your Machines or Game Servers, by security breaches on them, or by your use of the Software is your responsibility. You use the Software at your own risk.

12. Content

HaruHost allows you to post, link, store, share and otherwise make available information, text, graphics, files or other material ("Content"). You are responsible for the Content you post on or through the Service, including its legality, reliability and appropriateness.

By posting Content on or through the Service, you represent and warrant that: (1) the Content is yours or you have the right to use it and to grant us the rights in these Terms, and (2) posting it does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity. We may close the Account of anyone found to infringe copyright.

You retain all your rights to Content you submit, post or display on or through the Service, and you are responsible for protecting those rights. We take no responsibility for Content you or any third party posts on or through the Service. By posting Content using the Service, you grant us the right to use, modify, display, reproduce and distribute it on and through the Service as needed to provide the Service to you and to the people you share it with.

We may, but do not have to, monitor and remove Content.

13. Tunnel

HaruHost may provide a Tunnel for some supported Game Servers. It helps make a Game Server on your Machine reachable over the internet without port forwarding or firewall changes, including when your connection is behind carrier-grade NAT (CGNAT).

The Tunnel does not host your Game Server or move it to HaruHost; it stays on your Machine. Traffic between your players and your Game Server passes through a HaruHost relay server in the region you choose, so the relay handles your and your players' IP addresses.

The Tunnel may add latency, and the connection depends on the quality and stability of your own internet connection. We do not guarantee its availability, uptime, latency, connection quality or compatibility with any server, game, network or environment.

Some Game Servers need specific settings for the Tunnel. HaruHost may apply them for you through its connection guides and setup, which may restart the Game Server.

The Tunnel is experimental and may be changed, limited, interrupted or removed at any time without notice. Use it only as intended, with supported Game Servers and settings, and do not use it to carry any other traffic.

14. Discord bot and Discord features

You may connect HaruHost to a Discord server where you have permission to add the bot and choose its channels. HaruHost then posts the messages you set up, such as server status, player activity and game chat, relays messages between your Game Servers and Discord, and runs the commands you allow. You decide which roles may use each command, and you are responsible for what is done through them.

Discord's own terms and policies apply to your use of Discord.

15. Updates and support

We may provide updates to the Software that fix problems, add features or improve performance. The Software can install updates automatically; you can turn automatic updates on or off in its settings. We try to announce significant updates but do not have to.

We try to help when you contact us, but we do not guarantee support at any time or a resolution of any issue.

16. User conduct

You agree not to:

  • use the Service for any illegal or unauthorized purpose;
  • interfere with, disrupt or harm the Service, its relays or other users;
  • attempt to gain unauthorized access to the Service, other Accounts or related systems or networks;
  • use automated means, such as bots or scripts, to access the Service, except through the features we provide;
  • upload, transmit or distribute malicious code, viruses or other harmful software;
  • harass, intimidate or threaten other users;
  • violate any applicable law, regulation or third-party right.

17. Privacy

Our Privacy Policy (https://haruhost.com/policy/) describes what personal information we collect, why, who we share it with, and your rights. By using the Service, you acknowledge it.

18. Account deletion

You can stop using HaruHost at any time. To have your Account and the personal information we hold about you deleted, contact us at help@support.haruhost.com. We will ask you to confirm that the Account is yours.

Cancel any paid subscription first. Deleting an Account is permanent and cannot be undone; you lose its Plan, including any remaining time in the current Billing Cycle, its purchase history, Machines and settings.

Data stored on your own Machines, such as Game Servers, worlds, backups, player history and chat history, stays there until you delete it.

After deletion, we keep only the information we need to resolve disputes, enforce these Terms or meet legal obligations, as described in the Privacy Policy.

20. Intellectual property

The Service and its original content, features and functionality, excluding Content provided by users and third-party materials, are and will remain the exclusive property of Raidenku MB and its licensors, protected by copyright, trademark and other laws of Lithuania and other countries. Our trademarks and trade dress may not be used with any product or service without our prior written consent. Game names, artwork and other third-party materials belong to their owners; their use on the Service does not imply endorsement by or affiliation with Raidenku MB.

21. Disclaimer of warranties

Your use of the Service is at your sole risk. The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Raidenku MB, its affiliates and its licensors do not warrant that (a) the Service will be uninterrupted, secure or available at any particular time or place; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements.

22. Limitation of liability

To the extent the law allows, Raidenku MB, its affiliates and their officers, directors, employees, agents and suppliers will not be liable to you or any third party for any special, incidental, indirect, consequential or punitive damages, including loss of use, data or profits, whether or not foreseeable and on any theory of liability, arising out of or in connection with your use of, or access to, the Service.

Our total liability for any claim is limited to the amount you paid for the Service during the three (3) months before the event giving rise to the liability.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, or your rights as a consumer under the mandatory law of your country.

23. Changes to these Terms

We may modify or replace these Terms. If a change is material, we will give at least 30 days' notice before the new Terms take effect, in the app, on this page or in our Discord community. What counts as material is our decision, made reasonably.

By continuing to use the Service after a change takes effect, you agree to the new Terms. If you do not agree, stop using the Service and cancel any subscription.

24. Changes to the Service

We may modify, suspend or discontinue the Service or any part of it, temporarily or permanently, with or without notice. Where this affects a paid Plan you have, the Price and Plan changes section applies. Otherwise, we are not liable to you or any third party for any modification, suspension or discontinuation.

25. Termination

We may suspend or end your access to the Service at our discretion, without notice or liability, including if you breach these Terms. Your right to use the Service then ends immediately.

You may end these Terms at any time by cancelling any subscription and no longer using the Service; see Account deletion to have your data removed.

26. Governing law

These Terms are governed by the laws of Lithuania, without regard to its conflict of law rules. If you are a consumer, you also keep the protection of the mandatory consumer law of the country where you live.

If we do not enforce a right or provision of these Terms, that is not a waiver of it. If a court holds any provision invalid or unenforceable, the remaining provisions stay in effect.

27. Entire agreement

These Terms, together with the Privacy Policy and any other policies we publish for the Service, are the entire agreement between you and Raidenku MB about the Service and replace any earlier agreements about it.

28. Contact us

If you have questions about these Terms, contact us at help@support.haruhost.com.
